These Terms of Service ("Terms") govern your access to and use of the BookaBoost platform, operated by EVO Integrated Solutions LLC ("BookaBoost," "we," "us," or "our"). By creating an account or using the platform, you agree to these Terms.

1. Platform Description

BookaBoost provides AI-powered outreach automation for funeral homes, cemeteries, and pre-need organizations. The platform delivers voice calls, SMS messages, and emails to contact records you provide, with the goal of scheduling appointments between your advisors and prospective clients.

2. Eligibility and Account

You must be at least 18 years old and authorized to represent your organization to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.

3. Your Responsibilities

You agree that:

• You will only import contact records for individuals your organization has a prior business relationship with or has otherwise obtained legal authorization to contact.
• You will not use the platform to contact individuals on the National Do Not Call Registry without a valid exemption.
• You are responsible for compliance with the Telephone Consumer Protection Act (TCPA), CAN-SPAM, and all applicable federal, state, and local laws governing communications with consumers.
• You will not use the platform for any unlawful, deceptive, or harassing purpose.
• You will not attempt to reverse-engineer, scrape, or circumvent any security measure of the platform.

4. Acceptable Use

BookaBoost is designed exclusively for lawful pre-need and at-need outreach in the funeral and cemetery industry. Use of the platform for any other industry or purpose requires written authorization from BookaBoost.

5. AI Disclosure Requirements

Texas law (and regulations in other states) requires disclosure that a call is made by an AI. BookaBoost's AI call scripts include this disclosure by default. You must not modify or remove this disclosure from any AI call script.

6. Payments and Cancellation

Subscription fees are billed in advance on a monthly or annual basis. All fees are non-refundable except as required by law. You may cancel your subscription at any time; cancellation takes effect at the end of the current billing period.

7. Intellectual Property

BookaBoost and its licensors retain all intellectual property rights in the platform, including software, AI models, and documentation. You retain ownership of your data and contact records.

8. Disclaimer of Warranties

The platform is provided "as is" without warranty of any kind. We do not guarantee specific appointment booking rates, reply rates, or revenue outcomes. Results vary based on database quality, market conditions, and other factors outside our control.

9. Limitation of Liability

To the maximum extent permitted by law, BookaBoost's total liability to you for any claim arising out of these Terms or your use of the platform shall not exceed the fees you paid in the three months preceding the claim.

10. Governing Law

These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-law provisions. Any dispute shall be resolved in the courts of Dallas County, Texas.

11. Changes to Terms

We may update these Terms from time to time. Continued use of the platform after notice of changes constitutes acceptance of the updated Terms.
